Yes, they are common problem. You can fix 1. by pull the rubber off, rearrange them, and put them back on. Many foreign forum found out that Nokia just installed them wrong, since the 4 rubbers have slightly different height for the 4 spot they are installed in.
If that still doesn't work, use a file and cut down the rubber that is too tall.
As for 2. yes, that is also a common problem. Nothing to worry about. And it has nothing to do with MBN. MIF also reported that problem.
In fact, MIF has a problem that MBN does not have, some MIF have speaker problems, where it has a cracking noise. So far no MBN has reported to have that problem.
