車禍保險處理問題

能total lost當然最好，如果total lost後對方保險公司賠償我的金額是如何計算?是該車當前的市價嗎(未受損前)

我在美國也被撞過二次, 都是對方錯, 去向自己汽車保險公司談, 如果對方保險公司打電話來千萬不要跟他談, 告訴對方保險公司你要向自己汽車保險公司 claim, 一但跟對方保險公司打交道他會做各種限制(例如: 每天租車金額...等等). 去向自己汽車保險公司 claim 則不會做任何限制, 不是算你過錯, 因為自己汽車保險公司才不管你花多少錢都會去向對方保險公司收錢, 而且是回原廠修理.

Of course it's better to total your car and get a new one,
if it's not your fault,
call your insurance agent first,
tell him/her what you wanna do,
car accident in U.S. is insurance company's job (that's why you pay the "expensive" insurance fee),
your insurance company will deal with the 3rd party's insurance company,
that's the best and fastest way to get rid of your old car.
but you need to pay "deductable fee" first ($0, $500, or $1000, it depends on what your policy is,
if you wanna get a new car,
tell your agent to pay for it,
and he will bill the 3rd party's insurance company to get the money back (if it's NOT your fault)
easily speaking,
all the bills will be on the driver who made this happen.
if it's not your fault,
go ahead to choose a proper car for yourself and let the other driver pay for it.
Be ware,
if he/she doesn't agree with your request,
then you will need a lawyer.
Don't be afraid to go in a law sue,
again, if it's NOT your fault,
you will NOT be the one who pays for a lawyer,
and many lawyers are willing to sue him/her for you (earn some money).
This is America!
