出生
有的國家根據出生地主義（屬地主義），有的國家根據血統主義（屬人主義），假如僑民所有的子女，一出生就會同時具有雙重國籍，或者父母的國籍不同，而使出生的兒童擁有雙重國籍。部份不承認雙重國籍的國家，允許此情形的未成年人在成年之前擁有雙重國籍。
婚姻
有些國家的法律規定，本國男子與外國女子結婚，外國女子自動獲得本國國籍；而女子所屬國的法律又規定，因與外國人結婚，並不喪失本國國籍，則該女子就獲得了雙重國籍，反之亦然。
歸化
歸化程序在很多國家一般不會影響申請人先前的國籍，但有些國家的國籍法雖規定歸化時需提出放棄或喪失原有其他國家國籍證明，但若在因非可歸責當事人事由下，此類人士仍具有雙重國籍。此外，也有歸化外國後，卻遲遲未向出生國提出放棄原有國籍者，有可能因為法律疏失，甚至又申辦護照，於是暫時非法享有雙重國籍。

The language of the current Oath is found in the Code of Federal Regulations Section 337.1 and is closely based upon the statutory elements in Section 337(a) of the INA.
