Just want to let everyone knows that Apple did have the policy which if after 3 major repair, you will have a replacement for a new laptop. I've a MBP CD 2.0 originally and send for repair about the high frequency noise for 3 times, I've got it replaced today with the current generation MBP. They originally give me the 2.4Ghz modal, but I paid the difference and upgrade it to 2.5Ghz one. It is almost 2am in my place now and I'll post the pictures later to proof.
In the U.S., it’s different states’ state laws that maintain such right of consumers.
If your machine have been repair for more than 3 times (Major Repair) and the problem persist, you may consider sending E-mail to AppleCare Customer Relations and request a replacement machine.
As for the definition of Major Repair, look at your repair report, for MacBook Pro, a part number begins with 678- is considered as major repair.
